Exceptions to the Search Warrant Requirement:

Aside from the three legal theories noted above, there are at least seven other justifications for the search and/or seizure of evidence without the need for a search warrant, as discussed below:

  • Plain Sight Observations
  • Plain Hearing
  • Plain Smell
  • Special Needs Searches
  • Exigent Circumstances
  • Closely Regulated Businesses or Activities
